Terms of Service
The agreement between you and Lekamail, Inc.: your account, what you own, postcards and time capsules, plans, refunds and how to leave with everything.
Who we are and these terms
Lekamail is provided by Lekamail, Inc., a Delaware corporation with its principal office at 1050 Bishop Street, Suite 400, Honolulu, HI 96813, United States (“Lekamail”, “we”, “us” or “our”).
These Terms of Service (the “Terms”) are a binding agreement between you and Lekamail, Inc. They apply to lekamail.com, the Lekamail web, desktop and mobile apps, and every @lekamail.com address and related feature (together, the “Service”).
By creating an account or using the Service, you agree to these Terms, our Privacy Policy, our Cookie Policy, our Acceptable Use Policy and our Time Capsule Promise. If you do not agree, please don’t use the Service. The current version of these Terms always lives at lekamail.com/terms.
Who can use Lekamail
You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, to create an account. If you are under the age of majority where you live, a parent or guardian must agree to these Terms on your behalf.
If you use Lekamail on behalf of an organization, such as with a custom domain for a business, you confirm that you have authority to accept these Terms for that organization, and “you” includes it.
You may not use the Service if you are barred from receiving it under the laws of the United States or any other applicable jurisdiction, including sanctions and export control laws.
What Lekamail does
Lekamail is a personal email service. It gives you an @lekamail.com address, sets letters written by real people apart from receipts, updates and newsletters (which live in “Everything else”), and lets you send photo postcards, voice letters with transcripts, and time capsules that are delivered on a date you choose.
We work hard to keep Lekamail fast and available, but we can’t promise it will be uninterrupted or error-free. We may carry out maintenance, and we will give advance notice of planned downtime whenever we reasonably can.
We improve Lekamail over time. We may add, change or retire features. If we remove a feature that is a material part of a paid plan, we will tell you at least 30 days in advance and offer a pro-rated refund if you choose to cancel as a result. Features labelled as previews are offered as they are, and may change or end sooner.
Your account and address
When you sign up, please give us accurate information and keep your recovery email up to date. It is the only way we can help you back in if you lose access.
You are responsible for keeping your password, passkeys and devices secure, and for everything that happens under your account. Please tell us straight away at hello@lekamail.com if you think someone else has accessed it.
Each account is for one person. On the Parcel plan, each family member gets their own private account and inbox. Please don’t sell, trade or transfer an address or account.
Your @lekamail.com address is yours for as long as your account is active. We may decline or reclaim addresses that impersonate others, infringe trademarks, or are reserved for operational use. Free Postcard accounts that have not been signed in to for 24 months may be closed after we send two reminder emails to the address and to your recovery email. Closed addresses are never reissued to someone else.
Your letters and content
You own everything you write, send, receive and store with Lekamail, including your mail, photos, voice recordings, transcripts, contacts and time capsules (“Your Content”).
You grant Lekamail a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display and process Your Content only as needed to provide, secure and support the Service for you, for example to deliver a postcard, generate a transcript you asked for, or keep a backup. This licence ends when Your Content is deleted from our systems.
We never sell Your Content, never use it for advertising, and never read it to sort your mail. Letters are recognised using sender and delivery signals, as described in our Privacy Policy.
You confirm that you have the rights needed to send and store Your Content, and that it does not break the law or anyone else’s rights.
Postcards, voice letters and time capsules
Photos and recordings you send are stored with the same protection as your mail. When you send a postcard or voice letter to someone outside Lekamail, they receive a regular email with a private link to the full-size photo or recording. You can revoke that link at any time.
Voice letters include a transcript that we create for you. You can edit it before sending, and you should check it, because transcripts can occasionally mishear a word.
Time capsules are sealed letters delivered on a date you choose, up to 25 years in the future. You can edit or cancel a capsule until 24 hours before delivery. How we seal, store and deliver capsules, including what happens if Lekamail ever closes, is set out in our Time Capsule Promise, which forms part of these Terms.
Using Lekamail kindly
Lekamail is for personal correspondence. You agree not to use it to send spam or bulk unsolicited mail, run scams or phishing, spread malware, harass or threaten anyone, impersonate others, infringe intellectual property, share child sexual abuse material, or do anything else unlawful.
You also agree not to probe, scan or test the Service’s security without our written permission, interfere with its operation, scrape it, get around sending limits or other technical limits, or resell the Service without our agreement.
The full rules, including sending limits, are in our Acceptable Use Policy at lekamail.com/acceptable-use.
Plans, billing and renewal
Postcard is free forever and is not a trial. It includes 10 GB of storage, the Letters view, ten postcards a month, voice letters up to 2 minutes and one time capsule.
Letter costs $3 a month, or $2.50 a month billed yearly. Parcel costs $6 a month, or $5 a month billed yearly, for up to five people. Prices exclude any sales tax, VAT or similar tax, which we add where required and show before you pay.
Paid plans are billed in advance and renew automatically at the end of each monthly or yearly period until you cancel. We will remind you by email at least 7 days before a yearly plan renews. You can cancel at any time in Settings → Plan, and cancellation takes effect at the end of the period you have paid for.
Upgrades apply straight away, and we charge the pro-rated difference for the rest of your current period. Downgrades apply at the end of the period you have paid for. If a downgrade would put you over your new storage limit, you can still read and export everything, but you won’t be able to receive new mail until you are back under the limit.
If we change the price of a plan, we will email you at least 30 days before the new price applies to you, and you can cancel before it does. If a payment fails, we will retry and let you know; if it still fails after 14 days, your account moves to the free Postcard plan and nothing is deleted.
Free trials and refunds
The Letter plan may be offered with a 30-day free trial. We will remind you before the trial ends, and you won’t be charged if you cancel before then.
If you cancel a yearly plan within 14 days of purchase or renewal, we refund the full amount. Monthly plans are not refunded for part-used months, but you keep access until the end of the month.
Nothing in these Terms limits any statutory right you have to cancel or to a refund under the consumer laws of the country where you live.
Our service and brand
Lekamail, Inc. owns the Service, including its software, designs, stamps, illustrations and the Lekamail name and logo. We give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service in line with these Terms.
Please don’t copy, modify, reverse engineer or build derivative works from the Service except where the law expressly allows it, and don’t use our name or logo in a way that suggests we endorse you.
If you send us feedback or ideas, we may use them freely and without owing you anything, but we will never identify you publicly without asking.
Copyright complaints
We respect intellectual property. If you believe content shared through Lekamail infringes your copyright, send a notice under the Digital Millennium Copyright Act to legal@lekamail.com or to our postal address, marked “Attention: Copyright Agent”.
Your notice should identify the work, the material you believe infringes it and where it can be found, your contact details, a statement of good-faith belief that the use is not authorised, and a statement under penalty of perjury that your notice is accurate and that you are the owner or authorised to act for the owner, with your physical or electronic signature. We terminate the accounts of repeat infringers in appropriate circumstances.
Privacy
Our Privacy Policy explains what we collect, why, and how long we keep it. In short: no ads, no selling data, no advertising profiles, and tracking pixels removed from incoming mail.
You choose where your data lives when you sign up, in the United States (Oregon) or the European Union (Frankfurt), and you can move regions at any time. Residents of the European Economic Area, the United Kingdom, California and other places with privacy laws have the rights described in the Privacy Policy, and can exercise them by writing to privacy@lekamail.com.
Suspension and closing accounts
You can export your mail and contacts and close your account at any time from Settings → Account. When you close an account, we delete your mail and content within 30 days, and from backups within a further 60 days, except where the law requires us to keep something longer. You can ask us to keep forwarding your address before you go.
We may suspend or close an account that seriously or repeatedly breaks these Terms or the Acceptable Use Policy, that puts other people or the Service at risk, or where the law requires us to. Unless the law or a safety risk prevents it, we will tell you why and give you a chance to respond and to export your content.
Sections that by their nature should continue, including ownership, disclaimers, limits of liability, indemnity and dispute resolution, survive the end of these Terms.
Disclaimers
We build Lekamail with care, but to the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Email depends on networks and servers that Lekamail does not control. We do not guarantee that any message will be delivered by another provider, that mail will never be misfiled between Letters and Everything else, or that a transcript will be word-perfect.
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, pandemics, war, acts of government, power or internet outages, or attacks on the wider internet.
Limits of liability
To the fullest extent the law allows, Lekamail, Inc. and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and one hundred US dollars ($100).
Some places do not allow these exclusions or limits, so they may not all apply to you. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
Indemnity
If you use Lekamail for business purposes, you agree to defend and indemnify Lekamail, Inc. against third-party claims, and related reasonable costs, arising from Your Content or your breach of these Terms or the law. We will tell you promptly about any such claim and may choose to take part in the defence with counsel of our choosing.
This section does not apply to consumers to the extent consumer protection law does not allow it.
Resolving disputes
Most concerns can be sorted out quickly by talking to us. Before filing a claim, please write to legal@lekamail.com with a description of the issue, and give us 30 days to try to resolve it informally.
If you live in the United States, any dispute that we can’t resolve informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Honolulu or by video. Either of us may instead bring an individual claim in small claims court. You and Lekamail each waive the right to a jury trial and to take part in a class action or class arbitration. You can opt out of this arbitration agreement by emailing legal@lekamail.com within 30 days of creating your account.
These Terms are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-laws rules, and, where applicable, the Federal Arbitration Act. If you live outside the United States, you keep the protection of the mandatory laws of your country and may bring proceedings in your local courts.
Changes to these terms
We may update these Terms as Lekamail grows or the law changes. For significant changes, we will email you and show a notice in the app at least 30 days before they take effect. Minor changes, such as clarifications or fixing typos, may apply straight away.
If you don’t agree with a change, you can export your content and close your account before it takes effect, and we will refund any unused prepaid amount for a yearly plan. If you keep using Lekamail after the change takes effect, you accept the updated Terms.
General terms and contact
These Terms, together with the policies they mention, are the entire agreement between you and Lekamail about the Service. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a right straight away, we haven’t waived it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets, and we will tell you if we do. Nothing in these Terms creates a partnership, agency or employment relationship.
You agree that we may send you notices about your account and these Terms by email or in the app, and that these count as written communications.
